Special Magistrate and Administrative Hearing Judicial Processes

The city of Miramar currently has two compliance processes in place. We strive to establish working relationships with our property owners remaining hopeful that the violations will be corrected, as such these processes are used as a last option to gain voluntary compliance. Both processes are similar in that violations must be observed by a code compliance officer before the issuance of an official notice. However, a few factors, such as the type and severity of a violation, determine which process is more applicable. We have provided a brief breakdown of each process for informational purposes. Be reminded that each property and its circumstances may or may not warrant action to be taken by the code compliance division.

Special Magistrate Process:

  • The code officer identifies the violation based on the city’s ordinance.
  • An official notice of violation is issued.
  • Compliance renders the case closed OR
  • Non-compliance at this stage results in a hearing.
  • A hearing is scheduled.
  • Fine(s) and/or lien(s) are assessed against the property.

Administrative Hearing Process:

  • The code officer identifies the violation
  • An official civil violation notice is issued
  • Compliance renders the case closed OR
  • Non-compliance at this stage results in daily fines for up to 20 days
  • The alleged violator must request a hearing to dispute the fines
  • Lien(s) are assessed against the property
